I felt I was the defendant!
I entered
the witness box, right hand on the bible repeat after the usher, ‘I swear
that the evidence that I shall give, shall be the truth, the whole truth and
nothing but the truth, so help me God’
My #CPSlawyer asked me my full name, address, she asked me
about the day of the collision. RTC
I gave a statement, (about) 90 minutes after been taken out
from a left hook by two Policemen, who cautioned me; WTF I thought, I am the
bloody victim here!. This was in
November 2017
I recited my statement from memory, but I was, thinking; why
not show all the video(s), there clear-cut? Anyway I carried on. The #CPSlawyer showed the crude drawing of
the road layout of the junction. Traffic
lights, road markings, cycle lane and ASL (Advance Stop Line).
#CPSlawyer continued asking me about the first encounter of
the defendants’ car. I said at the first
set of red traffic lights, it turned green & I proceeded behind the defendant’s
car, we turned right into Ha Ha Road, with me behind the car. The car drove off has there was hardly any
traffic ahead. Around 300 metres I
encountered the car again, straddling the cycle lane (dash lines), applied a
little braking as the space was cut down by the car driving in the cycle lane. I shoulder checked to the right & said
“You get off” (Loud, but not shouting), then looked around again, no response so
carried on.
The rest you can see in the video on twitter, however I would
like to concentrate on the defendant’s lawyer.
During the trail
defence lawyer, trying to say, ‘I put it to you sir, you was riding furiously
and was not going to stop for anyone’, err I said 16.8mph? & I checked this
via GPS software mate. Then he also said I edited the videos to suite my case? I almost lost it! However, I remembered what
my lawyer said; keep calm & breath. The judge looked at me; I said no, that
would be similar like perjury! I Stumped
him. My lawyer smiled at me. Also the defendant said that I hit the back
of her car??, the video(s) shows the contact was at the front passenger door.
He also put it to me, Mr K-------- Isn’t it true you regard
yourself as a vigilante? I said what!!! Do you know what a vigilante means? He
never said anything. I went on, the meaning
of a vigilante (basically), is a person(s) who takes the #law into his or her
hands, I and many others who use a helmet cam / dashcam /CCTV etc. obtain
footage & relay it to the #Police, then it is up to the Police/CPS to
either bring that person(s) to court or not.
Therefore, I will ask you a question, if I may, am I a vigilante. He moved onto another question. My lawyer gave me a smile.
This one is
classic. Defence lawyer; I put it to you
sir you gave no indication that you was going straight on? I almost ROFL, but
composed myself. I said, can you show me
how to indicate going straight on, & while you are at it show me how
vehicles would indicate to go straight? He
just smiled and said no further questions, however, if he said and showed ‘straight ahead' hand signal, right arm
raised, palm forward, OK I would hv said, but this is a very old signal &
most drivers would not get it & think you’re giving an Nazi salute,
however, I said, this does not pertain to this.
He also add, and tried to imply that the sun glasses I was wearing clouded my vision, that is why you sir did not see my clients indicator! I said, rubbish, the same sunglasses is on my head, woulds you like to take a look throught them Sir! no reply, he simply said. No further questions your honour.

That was it; I sat down at the rear of the court. We rise as the judge went out to deliberate. After around 25 minutes Judge enters the
room, we all rise. The Judge summed up
& after a very short pause, the Judge said we find you guilty.

for CPS,
Total=£980, &
4 points on her license.
